What Are My Options?
Do I Use the NVICP or Direct Litigation?

The law governing the National Vaccine Injury Compensation Program (NVICP) is quite clear: If an injury results from a vaccine that is listed in the NVICP Vaccine-Injury Table as currently updated, your only option is to file a claim through the NVICP.

Vaccine-injury claims are never handled in local or state courts.

Costs and Attorney Fees

In normal life, if you were injured in an accident, you would seek compensation by filing a lawsuit in a local or state civil court, where you would also be responsible for court costs and attorney fees.

The Vaccine Injury Compensation Program doesn't work that way. Instead, all vaccine-injury claims are handled through a special system established within the US federal courts, where all attorney fees are paid by the Vaccine Program. That means:

  • You will never be billed for our services, whether you win compensation or not.
  • You will never be charged a contingency fee.
  • You won't have to pay a retainer fee to your lawyer.
  • All money awarded to your loved one by this program is for their benefit. None is taken away to pay for legal expenses.
  • In cases where a vaccination resulted in death, all money awarded is paid to the estate of the decedent, again with no deductions for legal fees.
